THE IMPACT OF THE CONVENTION ON THE RIGHTS OF THE CHILD ON AFGHANISTAN’S EXECUTIVE AND JUDICIARY SYSTEM

Afghanistan is a landlocked country with an important strategic and geopolitical position in the South-Central of Asia. The population of this country is about 35 million. It is one of the youngest countries in the world, with around half of the country’s population (50%) is under 15. The situation of children in today Afghanistan is a serious issue. In Afghanistan, many children are subjected to the worst form of labor, physical abuse, sexual and psychological harassment. The government of Afghanistan has ratified the International Convention on the Rights of the child (CRC) in 1994. However, the first implementation report of this treaty was submitted to the CRC Treaty Body after 16 years in 2010. In this study, the status of children has been reviewed legally, judicial and executive in the light of Afghanistan's accession to the CRC. The obtained results from this study show that since 1994 when the convention was signed and ratified by the Afghan government, after two and half decade nothing has been done by the Afghan government. In other words, during this period (26 years) both government and non-governmental organizations have not shown enough efforts for improving child protection system in order to create a protective environment where laws, policies, services, behaviors and practices minimize children’s vulnerability and strengthen children’s own resilience. For improving the child rights, the government, non-governmental organizations and civil societies must work together to implement the CRC for reducing children vulnerability.
